Conservation Commission
                Meeting
        November 5, 2009

were the members present.

7:45 p.m., A Notice of Intent Public Hearing filed by Jonathan Cohen for the proposed demolition of an existing residence and various out buildings, and the construction of a new residence with associated site work at 203 Mountain Street, DEP FILE #SE-280-0511:

Applicant, Jonathan Cohen, and Engineer, Norman Clapp appeared before the Commission and submitted the green abutter cards and a proposed plan entitled, “Proposed Site Plan, Wetlands Filing, Lot 1, 203 Mountain Street, Sharon, MA, dated 9/18/09.” Jonathan explained to the Commission that the proposed project lies within the 100’ Buffer Zone of a 5.6 acre parcel.
The Conservation Administrator inspected the proposed project site and approved the BVW wetland line delineated by the Applicant’s Botanist, Walter Hewitson, on 6/16/09.
Jonathan explained to the Commission that the size of the proposed new house is 26’x 36’ with a 24’x 24’ attached garage. The new structures shown on the proposed plan are further away from the wetlands on the site. Prior to the proposed construction, all existing structures on the project site will be demolished and removed.
Engineer, Norman Clapp, explained to the Commission that the new septic system is being proposed at a 10’ higher elevation than the existing system to provide more protection to the wetlands on the site.
On December 9, 2009, the Applicant is meeting with the ZBA to request a special permit for the razing and replacement of the existing structures on the non-conforming lot.
Peg noted that the proposed project site contains significant wetland resource areas and offered the Applicant the opportunity to review the Conservation Restriction Boiler Plate document to determine if he would like to place a Conservation Restriction on the remaining lot to protect the wetlands in perpetuity.
The Applicant expressed his interest in permanently protecting the wetland areas on the proposed project site and asked to review a copy of the Conservation Restriction Boiler Plate document.
Peg requested that the Applicant mark out the Conservation Restriction Line on the proposed project site and define the Conservation Restriction Line on a plan for submittal to the Commission.
Elizabeth McGrath inquired as to the installation of an artesian well indicated on the Applicant’s proposed plan submitted to the Commission.
The Applicant explained to the Commission that the artesian well is proposed to be installed for irrigation and drinking water use.
Peg requested that the Applicant submit additional information to the Commission to determine the possible impact to the wetlands on the site from the proposed artesian well.
The Commission requested the following from the Applicant:
  • The Applicant’s initial feedback following his December 9, 2009 meeting with the ZBA
  • The Applicant’s review of the Conservation Restriction Boiler Plate document
  • To provide the Commission with additional information concerning his proposed artesian well
The Applicant agreed to comply with all of the Commission’s requests.
Peg called for a motion to continue the hearing until November 19, 2009 at 7:45 p.m.

8:15 p.m., Executive Session:
Peg called for a motion for the Commission to enter into Executive Session with Attorney Jon Rockwood to discuss pending litigations.
